Chhattisgarh HC: PhD Admission of Student Cancelled, Merit Issues

The Chattisgarh High Court allows the petitioner to take admission in Ph.D course after the allegations against the misconduct in admission by the university. HC cancels the waiting list admission and directs univ to pay litigation cost.

The Chattisgarh High Court has stopped admission of Ph.D student and said that the merit should not be compromised or obstructed on the face of unethical and unreasonable admission timings.

Justice Gautam Bhaduri’s bench in the Chattisgarh HC said while referring to a previous decision of the supreme court that the right of meritious students to take admissions in the postgraduate courses is a human-right which is needed to be protected and it cannot be curbed down for admissions for less meritious students.

The move to the high court was made by Rajiv Pratap Singh, a 24 years old Ph.D aspirant who alleged that he was deprived of taking admission in the Ph.D course while another candidate named Raj Kumar Das got the admission even after being on the waiting list. Singh’s name was on the third place in VRET (Vishwa Vidyalaya Research Entrance Test) Category whereas Das’s name was featured in the UR Merit list in the first instance.

The HC order stated that on 30th April 2019, the university announced the list of selected candidates asked for the admission fee payment on the same date. So many candidates failed and faced difficulties to deposit the prescribed fees in the short period of time.

The petitioner alleged that he was not allowed to take admissions by paying the fees as he was asked to present a certificate from the University of Wardha. The HC questioned if the reasonable time to take Ph.D admissions was given to the candidates.

The high court said that the fault does not lie with the petitioner as he had to go to the University of Wardha to get the M.Phil certification. He received the mail suggesting that on 30th April itself and by the time he could furnish the document, the time for fee payments were already over.

The court slammed the admission process by saying that the admission window closed in insufficient time. The arbitrary and defective procedure for admission only made obstruction in the path for merit.

The High Court cancelled the admission of Raj Kumar Das who was on the 1st place in the waiting list for Ph.D in Journalism and Mass Communication at Guru Ghasidas Vishwa Vidyalaya (GGV) and the petitioner has been given a 10 days timespan to take admissions in his desired paper in Ph.D by submitting the documents. The court has also directed the university to pay the petitioner the litigation cost of 15,000 rupees.
