Delhi HC Directs AIIMS to Compensate Rs. 50,000 to MBBS Aspirant

  • An MBBS aspirant from Karnataka must be compensated by AIIMS for not allowing him to take the AIIMS MBBS Entrance Exam 2018, ruled the Delhi HC.
  • The student was barred from the exam after his Aadhaar card was not scanned at the exam centre.

The High Court of Delhi has directed the All India Institute of Medical Sciences (AIIMS) to compensate Rs. 50,000 to an MBBS aspirant who was not allowed to appear for AIIMS MBBS 2018 entrance exam after his Aadhaar Card could not be scanned at the exam centre. The court further directed AIIMS to avoid such incidents in future.

The High Court observed that the Controller of Examination (CoE) of AIIMS resorted to a harsh attitude while unnecessarily depriving the MBBS aspirant of appearing in the entrance exam. It is not judicial to send back a student from the exam centre for the mistake he did not commit, the court pointed.

On the other hand, the court was reluctant to order a re-exam for the aspirant since it would disturb other students who have already appeared for the entrance exam.

Justice Pratibha M Singh indicated that the premier medical institute must compensate the candidate for its non-responsive attitude that led to harassment and frustration of the petitioner.

The court further directed AIIMS to include solutions to such problems in its brochure so that students can contact the concerned authorities if there is an issue during the exam. The premier medical institute must also give uniform instructions to the heads of all the exam centres, it added.

Earlier, the court sent notices to AIIMS and UIDAI (Unique Identification Authority of India) to file their response in a week. While UIDAI confirmed that the Aadhaar card/details of the candidate are genuine, AIIMS failed to file a counter affidavit.
