Delhi HC to DU: Provisional Certificates Valid until Degrees Issued

Once the students receive his degree only then the provisional certificate loses its sanctity.

Recently, Delhi High Court was approached by Vinod Kumar, a student belonging to the Scheduled Tribe category when he was denied admission in the top notch Delhi University on the basis of his provisional certificate. Regarding this matter, Justice Sanjeev Sachdeva ordered Delhi University to admit the student in the law course on the basis of the provisional certificate issued to him by Uttarakhand’s Garhwal University.

This order has further validated provisional certificates issued by a university till a degree is issued to the student. The High Court pointed out that denying admission to any student and not accepting his/ her provisional certificate is “not sustainable”.

It was further found out that Kumar had appeared for the law entrance exam conducted by Delhi University and had secured 49th rank in ST category. However, when he had approached the University he was denied admission on the basis of his provisional certificate.

He said that on August 28, date of the counselling, he had provided the university with all the required documents and certificates but was denied admission as he was not able to show his degree to the varsity. He was further told that the certificate could not be accepted as it was of 2010 and was old.

Regarding this, the court said that provisional certificates will be held valid until the students receive a degree from the university. Once the students receive his degree only then the provisional certificate loses its sanctity.
