On Tuesday, Gujarat Supreme Court passed the verdict of removing the 15% NRI quota offered by the medical and dental courses. This verdict has been passed against the ordinance by the state government as it was violating the directions issued by the Supreme Court.

Chief Justice R Subhash Reddy, led the division bench and said that the ordinance passed on June 10, regarding the admission procedure of NRIs in the medical and dental colleges in the state of Gujarat needs a few changes. He said that quota should be used only in case of genuine NRI’s and not for the people under the NRI dependent or NRI sponsored category.

The court also said that the quota was being misused by parties other than the genuine NRI’s and agreed that they cannot completely remove the NRI quota offered by the medical colleges and universities.

Regarding the people eligible to apply for quota, the court rulings said that the quota would be reserved or limited to those NRIs who are genuine and there is a need to remove the word “dependants” from the definition of NRI seats. Candidates who are “dependents or sponsors” of NRIs will not be eligible to apply under the quota. Also, the HC asked to reduce the percentage of quota mentioned in the ordinance.

Apart from this, the plea by the lawyer of one of the five petitioners, to put a hold on its order for two weeks has also been refused by the HC.
