High Court Slams CBSE for Not Notifying Students Regarding Re-evaluation

The CBSE board was slammed by the Delhi High Court after the former failed to notify its students regarding the changes in re-evaluation rules. The Court questioned CBSE and asked why it didn’t mention its website that re-evaluation was allowed in all subjects of class 12.

The court gave its remark when it was informed that the Board was reluctant to invite more re-evaluation applications after the verdict of the HC that asked CBSE to provide re-evaluation of the answer sheets of all the subjects for the students who sought re-evaluation.

In its defence, the Board said that according to a previous order of the HC, the deadline for accepting re-evaluation applications was July 7. CBSE also stated that re-evaluation of answer sheets cannot be an open-ended exercise.

A bench of Justice C Hari Shankar and Acting Chief Justice Gita Mittal disqualified the argument presented by CBSE. It also asked the CBSE why the students were not notified regarding the re-evaluation process.

The bench also said that CBSE gave a single day’s time to students in order to apply for re-evaluation i.e. July 7 while the students were uninformed about the decision of the court. The court also refuted the argument by saying that the deadline no longer applied as the decision was passed on July 6.

The court also said that this has caused a lot of inconvenience to the students as the relief provided by the court’s decision was not solely for the petitioners but should be applicable for all students who seek re-evaluation of their answer sheets.

The court also directed the lawyers of the petitioners (students) to file an application so that an appropriate order can be passed later.

The response came during the hearing of a plea that was filed by four students against the CBSE regarding the notice imposing certain conditions for the re-evaluation of answer sheets. The conditions were set aside by the High Court. Further hearing regarding this will take place on August 29, 2017.

The conditions for re-evaluation comprised that scrutiny was applicable only for 12 subjects. Students could apply for re-evaluation only for 10 questions per subject. Also, the CBSE had earlier stated that the mark sheet will only be awarded if the marks increased by five or decreased by one.
