SC Hearing on NEET UG 2024 July 8: The Supreme Court of India took up a hearing on NEET UG 2024 on July 8. More than 30 petitions were heard challenging the various irregularities of the NEET exam 2024 including paper leak, grace marks, revised results and exam cancellation petitions. SC Bench comprising CJI DY Chandrachud and Justices JB Paridwala and Manoj Mishra will hear the petitions.     Supreme Court Hearing on NEET UG 2024: Update #26

    CJI continues:

    Chart indicates, students receiving a specific level of marks between 539-700 who secured a particular rank in 2022 secured lower ranks in 2023 and radically lower rank in 2024. Court has been apprised that FIRs were registered in Patna, Delhi, Gujarat, Rajasthan, Maharashtra and Jharkhand. Whether the FIR in relation to paper leak is confined to Patna is a matter which requires detailed consideration. The exam was conducted over a wide spectrum of nearly 23 lakh students. The law on whether a retest should be ordered in such situation is based on fairly settled parameters.

    It will have to be scrutinized whether: (1) alleged breach has taken place at systemic level (2) whether the breach has affected integrity of entire exam process (3) whether it's possible to segregate beneficiaries of fraud from untainted students. 

    • In a situation where breach affects entirety of process and it's not possible to segregate beneficiaries from others, it may be necessary to order re-exam.

    • Where the breach is confined to specific centres and it's possible to identify beneficiaries of wrongdoing, it may not be proper to order re-test such an exam, which has been conducted on massive scale

    Supreme Court Hearing on NEET UG 2024: Update #25

    CJI dictates orders:

    NTA conducted NEET UG on May 5, 2024. Results were declared on 4 June, 2024. From material at present stage, it appears that on May 5, an FIR was lodged in Patna alleging a leak in the NEET UG 2024 question papers, implicating offences under various sections. On 23 June, 2024, Economic Offences Unit of Bihar police issued a press release (unofficial) noting that in connection with the above FIR, 13 persons including candidates and members of organized gang of exam leak. 

    In this batch, one of the prayers is for a court-mandated re-test of the exam. In support of re-exam, petitioners have relied on 2 circumstances: First, that candidates securing max 720 marks were confined to a few between 2020-2023. But in 2024, as many as 67 candidates are reported to have secured max of 720 marks. There has been a radical increase. Second, a comparative tabulation of the ranks which were allotted to students in 2022, 2023 and 2024.

    CJI has asked to identify two points to consolidate a conclusion on re-test:

    • (a) whether the whole exam is affected
    • (b) is it possible to identify wrong doers

    CJI asked to give a consolidated set of submissions not exceeding 10 pages regardin the same. A day's time was given, to which the petitioner asked the matter to be moved to next Thurday instead of this Wednesday.

    The students were memorizing answers on the test day, states CJI, and that may mean that the leak is not widespresad. But CJI also considered that if the paper was leaked through social media (Telegram), then the beneficiary candidates cannot be identified and it would form a basis for the re-test.

"At one place," SG Tushar Mehta said, "the beneficiary students were identified and their results are withheld. 13 people have been arrested so far for the same."

    Petitioner counsel continued that Bihar police has made a statement that NTA has not followed standard SOPs, hence the fault becomes at systemic level. It is at a large scale. NTA earlier stated that the identification of the fault has not been done at at systemic level yet. NTA claims that this has happended at a miniscule level, not systematic level.
