NEET PG Counselling 2021 has once again hit a snag. The Supreme Court (SC) will hold the hearing for the intervention plea tomorrow, that is on April 6, 2022. The Supreme Court has agreed to hear an intervention plea submitted to the Supreme Court by the State of Maharashtra which seeks to enable all the aspiring candidates who have joined the Round 2 State Quota Counselling to resign by April 6, 2022 and then subsequently participate in the All India Quota Round under the section of “not joined” aspirants on account of them submitting the resignation.

What is the NEET PG 2021 Special Round Counselling? 

The NEET PG 2021 special round of counselling was introduced recently under the direct orders of the Supreme Court. The NEET PG 2021 Counselling Mop Up Round results were pulled by the Supreme Court after several anomalies were pointed out in the counselling procedure. 

The Court has expressed dissatisfaction in the mop up round counselling regarding two salient points as mentioned below:

  • The addition of 146 new seats in the government colleges in the mop-up round counselling. This created a problem because these seats had not been available in Round 1 as well as Round 2. 

  • The notice dated March 16, 2022 as put forward by the Medical Counselling Committee (MCC) bars all the aspiring candidates who have taken admissions in the state quota from applying for the All India Quota (AIQ). The problem arose because this notification has not been uniformly applied everywhere. 

The bench of Supreme Court Justices which include Surya Kant, DY Chandrachud and Bela Trivedi has addressed the State of Maharashtra and requested that they send in a clarification regarding the seats that are being discussed in the intervention plea. The clarification entails that the State of Maharashtra must state that the intervention plea is only valid for the newly added 146 seats that will be included in the counselling for the NEET PG 2021 Special Round Counselling. 

Justice Chandrachud has also stated - “"We'll keep it tomorrow. You make the statement that this is for 146 seats which is covered by clause (2) of our orders. Take instructions and just make sure that you are correct on that. So long as Mr Patil clarifies that these are for 146 seats. You issue a clarification today and then we'll take it up tomorrow," said Justice Chandrachud”.

Meanwhile, Advocate Sachin Patil who is representing the State of Maharashtra countered that the intervention plea that had been submitted to the Supreme Court clearly stated whatever had been required in the clarification. 

He stated - "As per the advisory, the candidates resigned from the State Quota seats and went for AIQ Mop Up, but that was cancelled and directions were issued that all are eligible to participate. Yes, only for the 146 seat candidates who have resigned their seats. We requested them to join the seats because now they can participate in AIQ Mop Up counselling without prejudice”.
