Students hoping to get admission in medical colleges through NEET 2021 counsellingfor MBBS & BDS programmes have to wait for the final verdict of the Hon’ble Supreme Court of India. The counselling is expected to be delayed till January 2022. 

The latest notification of the Medical Counselling Committee released on 10 December 2021 has disclosed that the current scheme of NEET counselling has been challenged in the Supreme Court. It does not mention the exact reason for the delay.

Reasons for Delay in NEET 2021 Counselling

Here is a chronological explanation as to what triggered the delay in NEET-UG 2021 Counselling: -

  • In July, the Government had decided to provide 27% reservation to OBC and 10% reservation to EWS in the 15% of the medical seats are covered under the All India Quota.
  • The notification that declared the implementation of reservation following the rationale provided by the Supreme Court of India in Dr Pradeep Jain V. Union of India 1984.
  • Earlier, seats under the AIQ were not subjected to any reservation. It was provided for SC and ST according to the decision of the SC in Abhay Nath and Ors. V. University of Delhi and Ors.
  • The Hon’ble High Court of Madras decided that a committee be constituted to look into the matter of implementation of reservation for OBC in AIQ. The committee submitted its findings to the Health Ministry on 21 October 2020.
  • The ministry decided to provide 27% reservation for OBC and 10% to EWS in AIQ for NEET counselling 2021.
  • The matter was challenged in the SC on which the hearing shall begin on 6 January 2022.
  • The NEET 2021-22 counselling is also being delayed due to another matter pending in the SC for the conclusion. The rationale of fixing 8 lakh as annual income to claim reservation in the EWS category has been challenged in the SC and the court has sought some clarifications from the centre.

Meanwhile, resident doctors at various institutions have gone on strike demanding the speedy redressal of any issues and commencement of counselling for NEET PG 2021. Now, the counselling will commence after all the hurdles have been addressed and settled.
