CBSE Paper Leak: Supreme Court Dismisses Student Pleas Regarding Re-exam

The Supreme Court has dismissed five petitions filed by CBSE students regarding economics and mathematics re-exam. The apex court said that the discretion to conduct or cancel the concerned exams is with CBSE and the board has the right to take the decision in this regard.

CBSE’s decision to conduct re-exam for Class 10 Mathematics subject had enraged students and parents. All the hard work and efforts of many students to perform well in Maths exam went into vain after CBSE had cancelled the exam due to the question paper leak. Enraged with the CBSE’s decision, a Class X student from Kerala had approached Supreme Court on Mach 31, 2018, demanding CBSE to roll back its decision to conduct re-exam.

The Supreme Court bench of Justices L Nageswara Rao and S A Bobde also asked the students to comply with the decision of the Board whether or not it conducts re-exam for maths and economics paper. The CBSE had announced on April 3 that there is no need to conduct class 10 maths re-exam as the detailed investigation conducted by the board shows that the leak has not impacted the answer sheets. However, the Board has asked Delhi Crime Branch to continue it's investigation into CBSE board exam paper leak. The students who filed petition responded to this and said that it is not fair for the board to make its decision without completion of the investigation.

The petitioner, Rohan Mathew and his father, an advocate approached SC challenging the CBSE’s move. The petitioner alleged that CBSE cancelled the exam without any valid pieces of evidence on question paper leak. The question leak as stated by CBSE took place in Delhi. However, there were only rumors and speculations on the leak and CBSE relied on unconfirmed sources that stated paper leak. The petitioner further stated that mere apprehension was not enough to cancel the board exam.

CBSE should have conducted a thorough inquiry before taking a decision on the cancellation of the exam. The petitioner requested the court to look into the matter and direct the CBSE to roll back the decision of holding re-test and proceed with evaluation.

On the other hand, CBSE has also called for an investigation on the matter. Based on the report by investigative agencies, CBSE is expected to conduct Class 10 Mathematics re-exam only in Haryana and Delhi.
