Punjab and Haryana HC: No Longer 10% EBP Reservations in MBBS Admissions

Haryana government’s decision of reserving 10% seats for economically backward classes was put on hold by the Punjab and Haryana High Court on Thursday, 22nd September 2016. The government had proposed the same for MBBS course at Pt. BD Sharma University of Health Sciences, Rohtak.
After this new reservation, the total percentage of reserved seats had further increased to 60% which was found out to be contradicting the guidelines passed by the supreme court.

Division bench at Haryana and Punjab High court lead by Justices Rajesh Bindal and Darshan Singh ordered that the decision by Haryana government will not be taken into consideration while admitting students and no students will be admitted under any reserved category for economically backward classes in the current session or for the future sessions.
The court took this decision after hearing two MBBS candidates Kalindi Vashishtha and Rageshwari Singh appealed for the same in front of the bench. It was further clarified that not only students will no longer be admitted under the reservation category but also for those who have previously been admitted under the same will no longer be entitled to the benefit, and their admissions will be cancelled.

Now the court has given the next hearing date for January 20 in the next year. Till then the institute will now have to follow the order of the High Court and have also been permitted to carry out a fresh counselling process if required.
The advocate fighting on behalf of the petitioner was Mr. Sumeet Goel who argued the reservation of seats under the economically backward classes. He said that after reserving further 10% seats of the MBBS seats reserved for EBP category comes to 47 and these seats should be filled from the General category.
