The 5-Judge Bench of the Supreme Court has passed that the final year candidates are allowed to appear for the AIBE exam 2024, which will be held on November 24, 2024.

SC Judgement on AIBE XIX 2024 Final Year Students Plea: As per the current verdict, the three Judges of the Supreme Court, Dr DY Chandrachud, CJI, JB Pardiwala, and Manoj Misra, JJ passed an order, which allowed the final year candidates in the All India Bar Examination (AIBE) exam, which will be conducted on November 24, 2024.

After hearing a petition challenging the final decision proposed by the Bar Council of India for excluding the final-year candidates law candidates from AIBE registration, the Supreme Court passed the order. At first, the petitioners questioned that the decision taken by the BCI was contrary to the Constitution Bench Judgement.

Before today’s hearing, the Bar Council of India mentioned that they need time to frame the rules for final-year law candidates. Also, the Bench informed that they take time to frame rules and ensure that the final year law candidates should not lose a year. Consequently, the Supreme Court passed an interim order. In addition, the bench confirmed that the order would apply not only to the petitions for all the final-year law candidates.

In explanation, the Bench stated that in India, several recognized Institutes provide law degrees and publish results not at the same time, and a person on account for non-declaration of results might be lost out. Hence, their opportunity to participate in the All India Bar Examination for a long period of time will be shattered. Consequently, the Supreme Court confirmed that the candidates who have qualified for all the examinations can pursue the final semester of the final year law course and they can take part in the All India Bar Examination (AIBE) as well. Only the AIBE result will be subject to the person qualifying all the components needed under the course study of the College/ University.
