Agnipath Recruitment 2023: Supreme court marks the scheme valid

In a recent turn of events, a bench of Chief Justice DY Chandrachud and Justices JB Pardiwala and PS Narasimha of the Supreme Court of India marked the Agnipath Recruitment 2023 Scheme valid after it rejected earlier pleas filed against it.

Agnipath Recruitment 2023: On Monday, the Supreme Court of India validated the Agnipath Recruitment Scheme as it dismissed two petitions challenging a judgement by the Delhi High Court that earlier approved the central recruitment scheme for the armed forces. A bench of Chief Justice DY Chandrachud and Justices JB Pardiwala and PS Narasimha stated that candidates, who were previously selected for the defence forces through various stages of recruitment processes, such as rallies, medical and physical tests before the launch of the Agnipath scheme, shall not have right to appointment.

While dismissing the pleas filed by advocate ML Sharma and Gopi Kishan, the bench further stated that it would rather not interfere with the HC verdict since the court had dealt with all possible aspects. However, the bench of Justices posted a fresh plea pertaining to the IAF Recruitment before the introduction of the Agnipath Scheme for hearing on April 17, 2023. The Centre has been asked to file a response to the third plea related to Agnipath Recruitment 2023 in the Indian Air Force. Earlier, on March 27, the court had agreed to hear the petition filed against the Delhi HC judgement upholding the Agnipath Recruitment 2023 Scheme into the Armed Forces.

On February 27, the high court said that the Agnipath Recruitment 2023 Scheme was devised in the interest of the nation with the objective of maintaining national security.

For those who are unaware or new to the scheme, Agnipath Recruitment 2023 announced on June 14, sets up rules for the recruitment of young, eligible citizens in the armed forces. Candidates between 17.5 and 23 years of age can apply under this scheme. Upon selection, candidates would be inducted for a duration of 4 years before being granted regular service subsequently. Following the Centre’s validation of the scheme, several protests demanding a rollback took place across different states. On July 19, 2022, the Supreme Court moved the petitions challenging the Agnipath Recruitment 2023 Scheme to the Delhi High Court.
