Bombay HC: Next hearing on JEE Main 2023 postponement and 75% criteria on January 10

The first Bombay HC hearing on JEE Main 2023 was held today on the PIL for Postponement and 75% Criteria, and the next hearing is set for January 10, 2023, where the petitioner is asked to submit the supporting documents.

JEE Main 2023 official notification was released in December 2022. The exam is scheduled to be conducted on January 24 to 31, 2023. Usually, NTA releases the notification 3-4 months prior to the exam date, but this was not the case for JEE Main 2023. As per the timeline, only 40-45 days prior to the proposed date of examination, the notification was released. To which the students have retaliated against it and requested for a postponement till April 2023. A case was filed at the Mumbai High Court by petitioner Anubha Sahai where she claims for a postponement and 75% marks criteria to be scrapped.

Bombay HC 4th January 2023 Hearing outcome

The first hearing on the filed PIL was heard today, by the two-judges bench: Honourable CJ SV Gangapurwala & J Shri Sandeep V. Marne. As per the information, here is what has been concluded:
  • The petitioner has claimed for a postponement of the exams as the exam dates are clashing with state board exams and only limited time is available for candidates to prepare.
  • The petitioner pointed out that the 75% marks criteria was scrapped in JEE Main 2022 and the same should be followed in JEE Main 2023.
  • The bench asked the petitioner to submit the official JEE Main 2023 brochure to the court for the matter to be further taken up. The matter has been listed to be heard on January 10, 2023.

What to expect on January 10?

As the bench has clearly stated its needs before concluding to a decision, here is what can be expected to happen in the next Mumbai High Court hearing on January 10th, 2023:
  • The petitioner will have to file the asked documents, i.e., the Official Brochure of JEE Main 2023 as released by the NTA on the official website.
  • The bench will issue a new hearing date to review the documents filed. Also, if any additional documents are required, the same will be requested by the court.
  • The matter of the 75%marks criteria may also be addressed by the bench.
Further, if the court is convinced with the submitted documents, it will give its verdict on the next hearing date after January 10th, and if not, the matter will be continued. So, students may have a partial hope that the exams may be postponed, if the bench considers the situation, and if NTA does not press on continuing with the proposed schedule by providing the required proofs and needs for the continuation.
