Bombay HC Hearing JEE Main 2023: The High Court of Bombay has heard the plea filed by Anubha Sahai seeking JEE Main 2023 postponement and 75% criteria today, and the case has now concluded. The court only discussed the matter regarding postponement today and the issue of the 75% eligibility criteria has been posted to February 21, 2023. The court rejected the postponement petition and hence, JEE Main 2023 Session 1 will now be conducted as scheduled from January 24 to 31, 2023.

JEE Main 2023 Bombay HC January 10 Hearing: Major Highlights

The following are the major highlights of today's High Court of Bombay JEE Main 2023 issue:
  • The court said that 75% criteria is not relevant now and it can be taken up at the time of admissions in June 2023.
  • The court enquired about the pre-pandemic dates of the exam and noted them to be January and April. Also, the bench confirmed and noted the eligibility of the students for the second attempt even if they do not give the first attempt.
  • The court also asked for the board examinations date and stated that, even if they do postpone the exam now to April, it will again raise the same issue of lack of time for preparation considering board exams end in March.
  • The Additional Solicitor General of India stated that the petitioner has no locus to demand postponement.
  • In the order, the Bombay High Court states any order to postpone the exam will have detrimental effects and hence, the exam cannot be postponed. All the issues as per the petition are for the January attempt and if any candidate does not do well, he/she/they can appear again in the April attempt. Therefore, it will be inappropriate to postpone a pan-India examination.
  • The Bombay HC also reiterates the order from the Supreme Court of India to the high courts to not interfere in educational matters.

    On the basis of a PIL presented by a child rights activist, it would not be appropriate to postpone a pan-India level exam. The extraordinary circumstances as mentioned in the case do not appear to exist for restraining respondents from holding the January exam. Lakhs of students must have been preparing for this exam.

    The Bombay HC notes that the High Court cannot intervene in Education matters as per the orders of the Supreme Court.

    ACJ reiterates that the issue of the 75% eligibility is only relevant at the time of admission, he goes on to continue, and as far as the dates of the exam are concerned, there is a second attempt. The petitioner states that although there is another attempt in April, all attempts are equally important. Furthermore, it would adversely affect the students if the exam is not postponed.

    The ACJ questioned if they were to postpone the exam to April, there might be an issue again on the lack of sufficient time for preparation as the board examinations are scheduled in March. Sahai's lawyer stated that it won't disturb anything. ACJ questions again if the dates for any other examinations are clashing with JEE Mains, to which the petitioner replies, yes, some board exams are clashing.

    The ACJ asks Sahai's advocate about the dates for the examination in the previous pre-pandemic years. January and April, the petitioner responds and tells the bench that the pandemic situation disturbed the academic sessions and this year's exam can be conducted in April and May. But since the last year's selection process continued until November, the December 15th notification came as unexpected for the students.

    The judge then asked to present the 75% rule. NTA's lawyer responded that the petition is deficient. The petitioner has not filed the case with the information brochure and thus, any of its rules cannot be challenged without filing it first. The court then gave time until the second hearing to file the brochure.

    In the 4th January hearing, the first argument made was the clash of JEE Main 2023 session 1 with pre-boards and practical examinations. The second argument made was the delay in the release of the notification. When stated about the 75% eligibility criteria, NTA's lawyer responded that it is about the admissions and not for appearing for JEE Main 2023. In response, Sahai's lawyer stated that there is no point in appearing for the exam if admissions require 75% mandatorily for all students, including droppers.

    The following are the reasons why the students are demanding JEE Main 2023 postponement:

    • The exam notification was released in December, instead of the pre-pandemic regular timings of September.

    • Assam board has scheduled practicals from January 25 to February 15, 2023.

    • Bihar Board 2023 exams begin on February 01, 2023.

    • Due to the pandemic, the courses are running late and are not yet complete even as of now.

    • The previous year's counselling ended in November 2022 when it should have been by June/July as per the pre-pandemic calendar.

    JEE Main 2023 Bombay High Court: Schools closed in Delhi until Jan 15

    On Sunday, January 08, 2023, the Directorate of Education, Delhi, issued a regulatory in view of the severe condition of cold in the national capital. Accordingly, all schools in Delhi will remain closed until January 15. This will cause all pre-boards and practical examinations to be conducted afterwards while JEE Main 2023 session 1 is to begin on January 24. The exams for many students in the UT will thus clash. It is however to be noted that it will only be considered if the petitioner mentions it in today's arguments.

    The case by Sahai is not filed for 2020 students issue. It is only for Session 1 postponement and 75% criteria relaxation. The issue of 2020 students will not be brought up in court under this case. If required, another case will have to be filed for it.

    JEE Main 2023 Hearing Bombay HC January 10: Can a split decision be given on 75% criteria?

    The 75% criteria is for admissions and not for appearing for JEE Main 2023. If a split decision is given it will allow dropper students admission even if their 10+2 board percentage is less than 75% but the current 2022-23 students will not get admission without 75%. It will create a disparity between the students and even give undue advantage to dropper students. Hence, a split decision is less likely in this case.

    One of the major arguments given by Sahai is JEE Main 2023 Session 1 clashes with pre-boards and practical examinations. However, before the pandemic, these exams were conducted in January along with the first session of JEE Main, just how it is being done for this year. Both pre-boards and practical timings are usually decided by the school authorities and can be scheduled in the weeks before or after JEE Main 2023 without interfering in its conduct. Hence, the court is less likely to consider this argument.

    On January 02, 2023, Karti P Chidambaram, Member of Parliament, wrote to the education ministry regarding the one-time exemption of 75% criteria and inclusion of 2020 passed students. On January 04, 2023, the Union Education Minister, Dharmendra Pradhan, conveyed that the matter has been sent to the concerned department for necessary action. Hence, all decisions will likely be left to the ministry with no interference from the court.

    In the previous academic year, similar cases of requesting postponement of CBSE board exam, JEE Main, NEET UG and PG were taken to the high courts as well as the supreme court. In none of the cases had the court intervened in the conduct of the exams. Therefore, for JEE Main 2023 postponement case too, a similar outcome is expected. The court will most likely not postpone the exam and it will be conducted as scheduled from January 24 to 31.
