Delhi HC Directs Centre to Include Waiting List Medical Aspirant as NRI

The High Court of Delhi has directed the centre to include the student as an NRI candidate who has till now been on the waiting list for deemed universities to seek admission in MBBS course for the academic session of 2017-18 through National Eligibility cum Entrance Test (NEET-UG 2017). The candidate who sought relaxation appeared for the NEET-UG 2017 exam as a resident candidate. The directive given by the Delhi HC will help the student to approach the deemed university directly. The counsel representing the student accepted the HC’s directive.

The HC passed the order after the central government standing counsel informed the court that all the unfilled or vacant seats have been released or added to deemed universities. However, they clarified that they could only assure inclusion of name in the waiting list as an NRI candidate for the onward transmission to deemed universities.

The student who filed the petition completed his Class 12 in Saudi Arabia. His father is a resident of Madhya Pradesh while his mother is an NRI. He applied to NEET-UG 2017 as a resident candidate and further not as an NRI candidate. During the admission process, the authorities have not considered him in the NRI category. Therefore, he approached HC seeking justice.

According to an official notification issued by the centre on July 21, 2017, all the NRI candidates who registered under Indian/ UR category during the registration process were eligible for the admission under NRI quota. However, these candidates had to submit the supporting documents to the admission authorities by July 25, 2017. The student failed to submit the supporting documents within the stipulated date.
