Hyderabad HC Stays Fee Hike for PG Super Speciality Courses

The High Court of Telangana and Andhra Pradesh has stayed the decision of Telangana government to hike tuition fee for PG SS (Super Speciality) courses under management quota from the current academic session. The HC’s decision is considered as a step towards checking misuse of the provision for management quota seats in medical colleges across Telangana. The court directed the state government and other respondents to file an affidavit within two weeks. The next hearing of the course will take place on September 06, 2018.

Recently, the state government of Telangana had passed GO-78 , giving its approval to enhance the fees for PG SS courses to Rs. 25 lakh in all private non-minority and minority medical colleges across the state. On August 20, 2018, a PG medical aspirant filed a writ petition in Hyderabad HC seeking withdrawal of GO-78.

The petitioner alleged that the GO-78 was issued after the completion of the first round counselling process. Many students reported to the college and paid the fees as per the old structure. Therefore, the state government should not compel the students to pay extra fees as per the revised structure under GO-78, the petitioner submitted to the court.

The petitioner further pointed out that the state government did not follow MCI guidelines during the PG SS admission process . As per MCI rules, 50% of seats available in PG SS courses must be filled by the competent authority while the rest 50% of seats must be filled by the management of the institutes on the basis of merit. However, the government did not classify the seats in private medical colleges into convenor quota and management quota during first round counselling process, he added.

The petitioner further explained that the private medical colleges in the state took the advantage of the situation, and treated all the seats available in PG SS courses as management quota seats. The tuition fee was also charged as per the management quota fee structure. Now, the revised fee structure of PG SS courses as per GO-78 was in the range of 233% to 327%, he alleged.

There have been rumours that the state government had passed GO-78 on August 14, 2018, without any recommendation from the Telangana Admission and Fee Regulatory Committee.
