JEE Main 2023: Plea Filed in Bombay High Court Seeking Session 1 Postponement, 75% Criteria Relaxation

JEE Main 2023 postponement plea for deferment of its first session from January to April has been filed in the Bombay High Court. The petition also seeks relaxation in the 75% eligibility criteria.
JEE Main 2023 Postponed

JEE Main 2023: On December 26, 2022, Activist Lawyer Anubha Srivastava Sahai filed a petition in the Bombay High Court regarding the postponement of JEE Main 2023 January session. The plea is filed as a Public Interest Litigation (PIL) petition which challenges the National Testing Agency (NTA) over JEE Main 2023 notification issued on December 15, 2022. Additionally, the petition also seeks relaxation on the eligibility criteria of a 75% score at the 10+2 level. As of now, the Bombay High Court has announced the tentative date of listing as January 02, 2023.

The PIL petition quoted the short notice at which JEE Main 2023 notification was declared and JEE Main January Session 1 clashes with pre-boards, practical examinations, and several other state board examinations like Bihar Board.

"Most of the State boards have scheduled their pre-board exams and board exams in the month of January 2023,” the PIL filed by Sahai stated. “Therefore, students will find it difficult to appear in JEE Main 2023 examination. Therefore, the Mains examination planned in January 2023 is non-beneficial to the students because they won't be able to appear for the exam,"

The lawyer has also claimed that JEE Main notification is usually declared 3 to 4 months prior to the first session of the exam, thus providing enough time for the preparation. However, a short span of only over a month was provided this year. This formed the basis for seeking deferment of JEE Main 2023 Session 1 from January 2023 to April 2023, once the board examinations are over.

Furthermore, the PIL also highlights the implementation of 75% eligibility criteria and how it was not applicable until last year. With this change in the eligibility, lakhs of students will be affected, especially those who score high in the entrance exam but remain unable to match it in the theory exams.

"The eligibility of 75% in Higher Secondary Class Board Examinations will hit lakhs of students,” the petition reads, “There are candidates who can score very high in the Mains examination but may not have 75% minimum marks in their board examinations."
